Privacy Policy

1. Introduction

This Privacy Policy explains how VacantEdge, operated by Binh Ly ("VacantEdge," "we," "us"), collects, uses, discloses, and protects personal information in connection with vacantedge.io and our related services (the "Service").

This policy covers two distinct groups:
  • Users — people who create an account, subscribe, or otherwise interact with us directly.
  • Consumers (property-related individuals) — individuals, including property owners, whose information appears in our property database because it is contained in public records or licensed third-party data. These individuals are generally not our users and have not interacted with us directly.

Where a section applies to only one group, we say so.


2. Important Notice About the Nature of Our Data

VacantEdge aggregates publicly available and licensed data about real property and, in some cases, the individuals associated with that property. As a result:

  • We may meet the legal definition of a "data broker" under laws such as the California Delete Act and similar state statutes, which may require registration and compliance with deletion mechanisms.
  • Our property data is not a "consumer report," and we are not a consumer reporting agency under the Fair Credit Reporting Act (FCRA). Our data may not be used for any FCRA "permissible purpose" (credit, insurance, employment, housing eligibility, etc.).

3. Information We Collect

3.1 Information you provide (Users)

  • Account data: name, email, password.
  • Billing data: processed by our payment processor, Stripe; we receive limited transaction details and do not store full card numbers.
  • Communications: messages, support requests, and survey responses.

3.2 Information collected automatically (Users)

  • Usage data: features used, searches, pages viewed, actions taken.
  • Device/technical data: IP address, browser type, device identifiers, approximate location, and similar.
  • Cookies and similar technologies (see Section 8).

3.3 Information about property owners and properties (Consumers)

From public records and licensed third-party providers, we collect and process property-related information that may include:

  • Property address, parcel/APN, ownership records, sale history, and assessed value;
  • Owner name and mailing address;
  • Tax-delinquency status, code-violation records, permit history, foreclosure and probate filings, and vacancy indicators;
  • Skip-tracing outputs (e.g., contact information) where you request and we facilitate such lookups through a third-party provider.

We do not knowingly collect Social Security numbers, financial account numbers, or government-ID numbers of property owners through the Service.


4. Sources of Information

We obtain information from: (a) you directly; (b) your use of the Service (automated); (c) government and public records (county assessors, tax collectors, recorders, courts, city open-data portals, USPS-derived vacancy data); and (d) third-party data and skip-tracing providers. We do not control these sources and do not guarantee their accuracy.


5. How We Use Information

We use information to:

  • Provide, operate, secure, and improve the Service;
  • Create, display, and refine property records, the Vacancy Score, maps, watchlists, alerts, and exports;
  • Facilitate user-requested skip-tracing and direct-mail features;
  • Process payments and manage accounts;
  • Communicate with you (service messages and, where permitted, marketing — you may opt out);
  • Detect fraud and abuse and enforce our Terms;
  • Comply with legal obligations.

We do not use property-owner information to make, and do not permit it to be used for, decisions about a consumer's eligibility for credit, insurance, employment, or housing.


6. How We Disclose Information

We disclose information to:

  • Service providers / processors who act on our behalf (hosting and database via Vercel and Supabase, mapping via Mapbox, payments via Stripe, skip tracing via BatchSkipTracing, direct mail via Lob, and email via Resend) under contracts limiting their use of the data.
  • Subscribers (Users) who access property and owner data through the Service for permitted real estate purposes, subject to our Terms.
  • Legal / safety: to comply with law, respond to lawful requests, or protect rights, safety, and property.
  • Business transfers: in connection with a merger, acquisition, or sale of assets.

We do not disclose information to third parties for their own independent marketing.


7. "Sale" or "Sharing" of Personal Information

Under certain state laws (e.g., California), providing access to personal information about property owners to subscribers in exchange for payment may be considered a "sale" or "sharing" of personal information. To the extent this applies:

  • We disclose the categories of personal information involved (identifiers such as name and mailing address; property and public-records data; and any skip-traced contact data).
  • Affected consumers have the right to opt out. See "Do Not Sell or Share My Personal Information" or contact us at privacy@vacantedge.io.

8. Cookies and Tracking

We use cookies and similar technologies for authentication, preferences, security, and analytics. You can control cookies through your browser. We honor Global Privacy Control (GPC) signals as an opt-out of sale/sharing where required.


9. Your Privacy Rights

9.1 Rights for property owners / consumers (non-users)

Depending on your state, individuals whose personal information appears in our database may have rights to:

  • Know / access the personal information we hold about them;
  • Delete that information;
  • Correct inaccurate information;
  • Opt out of sale or sharing;
  • Limit the use of sensitive personal information (if applicable);
  • Be free from discrimination for exercising these rights.

To submit a request, contact privacy@vacantedge.io or use the Privacy Choices form. We will verify your identity before responding and may use an authorized agent process. We respond within the timeframes required by law (generally 45 days under the CCPA, extendable). If your state operates a centralized data-broker deletion mechanism (e.g., California's DROP), we will honor verified requests through it as required.

9.2 Rights for Users

Users have the same applicable state-law rights regarding their own account information and may also update account details directly in the app or by contacting us.

9.3 State-specific disclosures

Residents of California (CCPA/CPRA) and states such as Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and others may have additional rights and disclosures under their respective state privacy laws, including the right to appeal a denied request. 10. Data Retention

We retain personal information only as long as necessary for the purposes described here, to comply with legal obligations, resolve disputes, and enforce agreements. Account data is retained for as long as your account is active and for a reasonable period afterward. Property and public-records data is retained for so long as it remains relevant to the Service, and is refreshed and reconciled against source records on an ongoing basis, subject to the deletion rights described above.


11. Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. No method of transmission or storage is fully secure, and we cannot guarantee absolute security. You are responsible for safeguarding your account credentials.


12. Children's Privacy

The Service is intended for business users 18 and older and is not directed to children. We do not knowingly collect personal information from children under 13 (or under 16 where applicable). If you believe a child has provided information, contact us and we will delete it.


13. Data Location

We operate in the United States, and information is processed and stored in the U.S. If you access the Service from outside the U.S., you consent to processing in the U.S.


14. Third-Party Links and Services

The Service may link to or rely on third-party services with their own privacy practices. We are not responsible for those practices; review their policies separately.


15. Changes to This Policy

We may update this policy and will revise the "Last updated" date. Material changes will be communicated by email or a notice within the Service. Continued use after changes take effect constitutes acceptance.
